INFORMATION FOR APPLICANT

Brief Description of Assignment |
: |
Many uncertainties like the COVID-19 outbreak and other unforeseeable crises in the implementation of contracts including slowing down of procurement activities and construction works, partial/full suspension of works, inability or limitation to supervise the works contracts, delayed delivery of goods, etc., create challenges in contract management by the Employer/Engineer. In these circumstances, fulfilling the obligations of the Employer, through the Engineer, such as application of force majeure clauses, suspension of works and claims management require high level of due diligence. Furthermore, the subject project is of a large scale and complex nature, encompassing several districts and entailing a large number of stakeholders. In view of this, the Roads and Highways Department of the Government of Bangladesh, the Implementing Agency of the South Asia Sub-regional Economic Cooperation (SASEC) Dhaka-Sylhet Corridor Road Investment Project (the Project), will engage an International Contract Specialist (the Consultant) using part of proceeds of a loan for the Project to ensure fair, efficient and transparent contract management despite the prevailing pandemic and other uncertainties.
The Consultant shall perform the following tasks:
i. Review the contract documents, analyze the contractual issues with reference to the contract clauses and applicable laws and advise RHD on the approach to handle the issue;
ii. Advise RHD in issuing proper notices to the contractors/suppliers/consultants according to the provisions of the relevant contracts with those parties;
iii. Review the consulting contracts and discuss the feasibility of alternatives to meet the contractual obligations and advise RHD on communications with the consultants;
iv. Review the variations requests from contractors and consultants and advise the RHD on actions to be taken according to the provisions of the relevant contracts with those parties;
v. Assisting RHD in reviewing the claims from the contractors and consultants and advise RHD on the acceptability and steps to be followed;
vi. Assist in the preparation of draft contracts and contract negotiations for the recruitment of consultants and procurement of goods and works;
vii. Assist RHD to undertake effective and efficient contract management process including conducting knowledge sharing events;
viii. Undertake any other duties as may be reasonably assigned.

Experience, Resources and Delivery Capacity Required |
: |
The Consultant shall meet the following minimum requirements:
i. Bachelors in Engineering preferably in Civil Engineering.
ii. Legal Background will be an added advantage.
iii. Minimum 10 years of professional experience.
iv. Minimum 6 years’ experience in contract implementation using FIDIC Forms of
contracts of comparable scale and complexity, preferably in the transportation sector.
v. Minimum 4 years’ experience in providing advisory support for the implementation of works contracts using forms of contracts based on FIDIC preferably in the transportation sector.
vi. Preferably an accredited FIDIC trainer with proven good experience in developing and delivering training programs.
